Board Mailing

Last Thursday, October 4, 2018 the WSE HOA, INC  Board sent a brown envelope to all members.  Included in the envelope are New Bylaws and CC&R’s, notice of a Special Membership Meeting to vote on the bylaws, notice of an open house prior to the meeting to discuss the new bylaws and cc&r’s and a proxy vote.  Please review this information, bring your questions or concerns to the Open House and vote for or against the new by-laws and cc&r’s.  If you feel that the by laws and or cc&r’s can not be supported, PLEASE let the board know why and how they can be improved.  Thank You.

  1. Thank you for sending out all the documents. FYI, I attended an all-day seminar conducted by VF-Law, the nation’s leading law firm that deals with housing issues, and got to meet Rich Vial, Oregon State Representative, founder of VF-Law, and author of the handbook that you referenced in the mailer.

    In previous minutes it was still mentioned that the Board was going to have the bylaws/declarations reviewed by legal counsel, and I’d like to know if that was done for you to arrive at the documents that you’re presenting to us now. Was that done??? And if so, by whom? WHO is the attorney of record who advised the Board on this matter? As a homeowner (now times two, as we recently closed on the house right across mine), I am exercising my right to continue asking questions.

    When I registered for the seminar, I was surprised to know that there was an “account” started for our HOA, and when I inquired, without violating any attorney-client privilege, I was told that there would be no violation as they were not retained for service. The only thing they had on record was that someone from WSEHA, Inc. called to inquire about document amendments, and that Atty. Coxey was the person who entertained the inquiries. FYI, I have a scheduled appointment with him coming up.

    In a break-out session, Atty. Coxey spoke extensively about issues involving rules amendments done by HOAs. I learned a lot, and the most important thing I learned is that THE PROCESS by which the WSEHA, Inc. Board is presenting the proposals is flawed. I also now own the very handbook the Board used, and I am willing to share it with anyone else who may be interested in perusing it.

    1. We did not go with Coxey and Vial, et all. They wanted to bill us by the hour just for talking with them better yet reviewing the by-laws. The attorney we talked with gave us printed version of suggested changes (see my blog dated today). Attorney is Michael J. Lecurse. You say our process was flawed–how so? It would be nice if you’d let the board know specifically before you go out publicly and accuse us of wrongdoing. I really find that personally objectionable. By the way, we had plenty of room for everyone at the Kostur meeting on the 25th. Yes, we are trying to tie in Metzger Park for the annual meeting in January. Question away, you DO have that right and we honor it.j

  2. Thanks for the “noted” reply, but I actually had a question in my comments. I’d like to know what legal counsel provided advice on the creation of the documents, considering that in the last MINUTES, it was stated that the Board was STILL looking for an affordable legal service.
    I was hoping to see at least one board member at this seminar, considering this task is truly daunting, now on it’s 3rd year of deliberation.
    The seminar was well attended with over 300 attendees, and I was told that I was the only one from Washington Square Estates HOA, Inc.

    1. I must truly plead ignorance. What seminar? Where? When? One cannot be expected to be at some event when one does not know it exists. Was this communicated to the board at all?

      1. I did not know about the seminar either until Friday afternoon, when I saw an ad on TV — and I considered it Divine Providence/Intervention, as I happened to be in town and had nothing on my calendar for Saturday.
        You are correct, you cannot be expected to be at a seminar that you do now know about. I just mentioned it because I had hoped that since the Board was working hard on revisions and amendments, that you would take advantage of all available resources, and since I was informed that WSEHA, Inc. had already contacted VF-Law, you would’ve known about these seminars and workshops that they conduct nationwide.
        I apologize for my assumption. I guess I’m really just the type of person who goes over-and-above, ergo my company name is Perfect Plus Professional Support.
        I will be emailing all my notes to the yahoogroups.

    1. The board has only been posting the minutes after they are approved. The vote on the by laws and cc&r’s will take place at the Special meeting on Thursday, Oct 25 at 6:30pm at my home as stated in the letter. We are also having an open house on Monday, Oct 22 to discuss the by laws and cc&r’s. Hope that this makes sense to you. Call me if you have questions. Dianne
